1. Acceptance of terms

By accessing or using Brikly (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Brikly is a property portfolio management tool that helps Australian investors track properties, loans, rental income, expenses, and tax depreciation. The Service includes an AI-powered assistant for investment knowledge and portfolio analysis.

3. Not financial advice

The information, calculations, and AI responses provided by the Service are for informational purposes only and do not constitute financial, tax, legal, or investment advice. You should consult a qualified financial adviser, tax professional, or accountant before making investment or tax decisions.

Calculations and projections shown in the Service may be based on data you enter and may not reflect your actual financial position. We make no warranty as to the accuracy of any calculations.

4. Eligibility and accounts

  • You must be 18 years or older to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account at security@mida.com.au.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Upload or transmit malicious code, viruses, or harmful content.
  • Scrape, crawl, or extract data from the Service using automated means.
  • Attempt to reverse engineer any part of the Service.
  • Use the AI assistant to generate content that is deceptive, harmful, or in violation of applicable laws.

6. Your data

You retain ownership of the data you enter into the Service. By using the Service, you grant us a limited licence to process that data for the purpose of providing the Service to you. See our Privacy Policy for details on how we handle your data.

7. AI assistant

The AI assistant features use third-party AI models. When you use these features, relevant data (your messages and portfolio context) is sent to the AI provider. You should not submit information that you would not want processed by a third-party AI service.

AI responses may be inaccurate. Always verify important information with a qualified professional.

8. Availability and modifications

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice where practicable.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by Australian law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Service, even if advised of the possibility of such damages.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the app. Continued use after changes constitutes acceptance of the revised Terms.
